PostBidShip collects information about you when you access and use our websites (including but not limited to www.postbidship.com and web.postbidship.com), mobile applications, content, products, and services (collectively, the “Services”) and through other interactions and communications you have with us. Our Services are provided by PostBidShip, Inc., and its subsidiaries and affiliates (collectively, “PostBidShip”).  This Privacy Policy applies to information collected and used by PostBidShip unless any of its Services are subject to a separate privacy policy.  In this Privacy Policy, the words “including” and “include” mean “including without limitation”.

Your privacy is very important to us.  We have established this privacy policy to notify you, or in the case that you represent a business entity, you, and that business entity (“you”) of the type of information we may collect from users of the Services and to generally summarize how we use and protect that information.  Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it.

THE INFORMATION WE COLLECT

Information You Give Us

We do not collect any personal information about you unless you voluntarily provide it to us.  You may be required to provide certain personal information to us when you elect to: (a) register for an account with our Services; (b) sign up to receive product announcements, updates and notifications; (c) enter a promotion or contest sponsored by us or one of our partners; (d) sign up for special offers from selected third parties; (e) communicate with us via mail, email or a web post; (f) post messages on our Community Discussion Forums or leave feedback for other members; or (g) submit your credit card  or other payment information when ordering and purchasing products and services through our Services.  This personal information may include your name, employer, email address, mailing address and telephone number.  We may also collect financial information, including credit card numbers, associated card data and tax identification numbers, in the event you register an account and purchase Services from us.  Your payment information is collected and processed by a third-party vendor and is not stored or accessible by us.

Additionally, as part of the registration of an account with our Services, we require members registering as a service provider to submit certain commercial information such as a DOT number, Motor Carrier (MC) number, SCAC, and/or any other authority a service provider chooses to include. It is up to each member individually to provide this information and, while we will utilize and rely on third-party commercial services to verify this information, we cannot guarantee its accuracy. This information can be viewed by other members using our Services.

Information We Collect from Your Use of Our Services

When you access and use our Services, we collection information about you that includes the following general categories:

Usage and Preference Information

We collection information about how you interact with our Services, including the types of Services provided, time spent using the Services and other related transaction details. When you access the Services, we may use a web server log to automatically track and collect certain non-personally identifiable information, such as your Internet protocol (IP) address, referral pages and pages viewed, access times and other relevant statistics.  We also may use common information collection tools like pixel tags (also called beacons or clear gifs), which are small files installed on or called by a webpage or application, to retrieve certain information about your browser or device, including device type, operating system, browser type and version, website visited, time of visit, referring website, IP address and other similar information.  Another common identification technology we may use is cookies, which are small files placed on your computer’s hard drive or mobile device, to help recognize unique users and monitor general traffic and use trends.  Cookies help us to understand how you use and navigate our Services and, in turn, how we can make our Services more user friendly. With most web browsers, you can remove or reject cookies, or set your browser to prompt a warning whenever a cookie is sent.  It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your mobile device. If you choose to refuse or remove cookies, you may still use our Services, but this could affect the availability and functionality of our Services.

Device Information

We may collect information from and about your mobile device, including the hardware model, operating system and version, software and file names and versions, preferred language, device identification number, serial number, device motion information, mobile network information, device’s telephone number, timestamp, location, and stored cookies information.

Log Information

When you use our Services, we gather certain information automatically and store it in log files, which may include information like your IP address, browser type, domain names, operating system, internet service provider (ISP), access date/time stamp, application features or pages viewed, application crashes and other system activity, and referring/exit pages.  We use this information, which does not identify individual users, for the more efficient and useful operation of our Services, to analyze trends, to administer the Services, to provide general statistics regarding the use of the Services, and to determine areas of the Services that could be improved to enhance the user experience.  We do not link this automatically collected data to personally identifiable information.

Location Information

When you use our Services for load tracking, we collect precise location data about the trip from the application used by the driver.  We may also derive your approximate location from your IP address.  If you initially permit the collection of precise location from your mobile device per the permission system used by your mobile operating system, you can later disable it by changing the location settings on your mobile device.  This may limit your ability to use certain features of our Services.  Additionally, disabling the collection of precise location from your mobile device will not limit our ability to derive approximate location from your IP address.

The information third parties may collect

When you use our Services, certain third parties may use automatic information collection technologies to collect information about you or your device.  These third parties may include your mobile device manufacturer, your mobile network provider, and analytics companies.

The information these third parties collect may be associated with your personally identifiable information or they may collect information, including personally identifiable information, about your online activities over time and across different websites, applications, and other online services websites.  We do not control these third parties’ tracking technologies or how they may be used, and we are not responsible for their practices.  We encourage you to visit the third parties’ websites to learn more about their privacy policies.

HOW WE USE AND DISCLOSE YOUR INFORMATION

Please note that we may share your personally identifiable information with third parties we use to support our business or with whom we have a business relationship and among each of our affiliated companies.  We may share data with trusted partners for purposes of performing statistical analysis, sending you email or postal mail, or arranging for deliveries. All such third parties are prohibited from using your personal information except to provide these services to us, and they are required to maintain the confidentiality of your information.

Below are the general uses and possible disclosures of your information.

General Usage

We collect and use your personal information, including your email address, to facilitate our Services that you request.  We use your personal information and other information we obtain from your current and past activities on the Services to: (a) Provide, maintain, protect, help improve, develop new functionality, administer, and personalize our Services; (b) Provide product and service information; (c) Fulfill transactions or requests made by you; (d) Give you notice about your account and when updates to Services are available; (e) Resolve disputes; (f) Provide you customer support and troubleshoot problems; (g) Inform you about online and offline offers, products, services, and updates; customize your experience; (h) Detect and protect us against error, fraud and other criminal activity; (i) Carry out our obligations and enforce our rights arising from our Terms and Conditions and any contract entered into by you and us, including for purposes of billing and collections; (j) Perform analytics, industry and market research and such other purposes consistent with our legitimate business needs; (k) And as otherwise described to you at the time of your disclosure of your personal information.

You agree that we may use personal information, including your email address, to improve our marketing and promotional efforts, to analyze site usage, to improve our content and product offerings, and to customize the Services’ content, layout, and services. These uses improve our Services and better tailor them to meet your needs, so as to provide you with a smooth, efficient, safe, and customized experience while using the Services.

PostBidShip Community

Your name is displayed throughout the Services and is therefore available to other members. All of your activities with the Services will be identifiable to your username. Other members can see shipments you have listed or quotes you have placed on loads, your feedback rating and associated comments, your postings with the Services, and so on. Therefore, if you associate your name with your username, the people to whom you have revealed your name will be able to personally identify your PostBidShip activities. If you are involved in a transaction, we have features that allow parties to the transaction to view your email address and obtain your contact information to help complete the transaction. Further, we may send out notices to you or other community members regarding suspicious activity or policy violations in using the Services.

Load Tracking

When you agree with another user of our Services to provide load tracking data to the other user, we will provide location information to the user during the applicable trip.  By agreeing to provide load tracking data to the other user, you expressly agree to permit PostBidShip’s Services to access location services through your mobile operating system and consent to PostBidShip’s use of any location-based services, disclosure of your location data to the other user of PostBidShip’s Services with whom you agreed to provide load tracking data and disclosure of your location data for the reasons described above about how we may share your personally identifiable information with third parties.

You agree to defend, indemnify, and hold us and our employees, contractors, officers, and directors harmless from all liabilities, claims and expenses, including attorneys’ fees, arising out of, or resulting from you disabling the collection of location information by changing the location settings on your mobile device.

External Service Providers

There may be separate services offered by third parties that we refer to as external service providers that may be complementary to your use of the Services. If you choose to use these separate services, disclose information to the external service providers, and/or grant them permission to collect information about you, then their use of your information is governed by their privacy policy. We do not disclose your personal information, including your email address, to external service providers unless you provide your explicit consent. With your consent we may provide some of your personal information to the external service provider offering such services, for your convenience. To prevent our disclosure of your personal information to an external service provider, you can decline such consent or simply not use their services. Because we do not control the privacy practices of these third parties, you should evaluate their practices before deciding to use their services.

Internal Service Providers for Our Operations

We may use third parties that we refer to as internal service providers to facilitate or outsource one or more aspects of the business, product, and service operations that we provide to you and therefore we may provide some of your personal information, including your email address, directly to these internal service providers. These internal service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit their use of the information we provide them for any other purpose except to facilitate the specific outsourced PostBidShip related operation unless you have explicitly agreed or given your prior permission to them for additional uses. If you provide additional information to an internal service provider directly, then their use of your personal information is governed by their applicable privacy policy.

Legal Requests

We cooperate with law enforcement inquiries, as well as other third parties to enforce laws, such as: intellectual property rights, fraud, and other rights, to help protect you and the PostBidShip community from bad actors. We may disclose your personal information without notice (and you authorized us to): (a) if required to do so in the good faith belief that such action is necessary to confirm to the edicts of the law or comply with law or legal process (such as a subpoena, court order or substantially similar legal procedure) served on us or our Services; and/or (b) to protect and defend our rights or property; and/or (c) act under exigent circumstances to prevent physical harm or financial loss of our users or the public, or in connection with an investigation of suspected or actual illegal activity.

Except as set forth above, we do not rent, sell, or trade any personally identifiable information and will not share your personally identifiable information with any third party.  We reserve the right to transfer your personally identifiable information in the event we sell, merge or transfer all or a portion of our equity, assets, or business.

YOUR CHOICES

Account Information

You may correct your account information at any time by logging into your account.  If you wish to cancel your account, please contact us as set forth in this Privacy Policy.  Please note that in some cases we may retain certain information about you as required by law or for legitimate business purposes to the extent permitted by law.  For instance, if you have a standing credit or debt on your account, or if we believe you have committed fraud or violated our Terms and Conditions, we may seek to resolve the issue before deleting your information.

Rights Concerning Your Personally Identifiable Information

If you provide us with personally identifiable information, you have the following rights with respect to that personally identifiable information to:

(i)  Review the personally identifiable information that you have supplied to us;

(ii)  Request that we correct any errors, outdated information, or omissions in the personally identifiable information that you have supplied to us;

(iii)  Request that your personally identifiable information not be used to contact you;

(iv)  Request that your personally identifiable information be removed from any solicitation list that we use;

(v)  Request that your personally identifiable information be deleted from our records; and

(vi)  Opt out of being solicited by us.

If you request that your personally identifiable information be deleted from our records, there may be a brief delay in our processing that request while we verify that the request is valid and originates from you as opposed to an unauthorized third party. If you request that your personally identifiable information be deleted, we reserve the right to terminate any account you have registered with us or limit your access to the Services.

HOW WE PROTECT YOUR INFORMATION

The security of your personally identifiable information is important to us. We take reasonable precautions to protect it. Information that is collected that is deemed to be confidential (such as credit card information) will be collected in a manner to prevent unauthorized access, use or disclosure using encryption such as secure socket layer (SSL) protocol.  Data is also encrypted in our databases, behind secure firewalls, and only accessible by authorized staff within our organization.  Additionally, most Internet browsers also offer their own security features that enable end users to control how their transmissions are protected.

We follow generally accepted industry standards to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the Internet or any wireless network or method of electronic storage can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information using commercially acceptable means, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and use through our Services cannot be guaranteed.

E-MAIL COMMUNICATIONS FROM THE SERVICES

From time to time, we may contact you via email for the purpose of providing announcements, information on products, services, promotional offers, alerts, confirmations, surveys, and/or other general information.  You are signed up for these emails at registration or within your account settings.  Out of respect for your privacy, we provide you a way to unsubscribe from these communications.  You may opt-out of receiving any electronic communications from PostBidShip by following the directions to unsubscribe, either as provided in such communications, through your account settings or as instructed by a customer service representative.  You can also unsubscribe by sending us a message at support@postbidship.com to request an unsubscribe.

LINKS TO OTHER WEBSITES AND SERVICES

For your convenience, PostBidShip Services may contain links to other websites or services that are external to us and are operated by our partners or affiliates (each an “Affiliated Company Websites”) that are not owned or controlled by PostBidShip. To the extend our Services contain links to Affiliated Company Websites, please check the individual Affiliated Company Website for its applicable privacy policy, which may differ from this one, depending on the specific nature of that Services and the transactions taking place there.  If an Affiliated Company Website has its own privacy policy, the provisions of that policy will control, to the extent of any conflict with this Privacy Policy.

COMMUNITY DISCUSSION FORUMS

If you use any bulletin board type of functionality as part of our Services, you should be aware that any personally identifiable information that you submit on the bulletin board, including your email address, may be read, collected, or used by other users of such functionality, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in this manner.

ACCESS TO PERSONALLY IDENTIFIABLE INFORMATION

If your personally identifiable information, including your email address, changes, or if you no longer desire to use our Service, you may correct, update, delete or deactivate it by making the change in your account settings or by contacting PostBidShip Customer Support at support@postbidship.com.

MINORS UNDER THE AGE OF 13

The Services are not intended for use by minors under the age of thirteen.  We do not knowingly collect personally identifiable information from minors under the age of thirteen. If you are under the age of thirteen, you may use the Services only with the consent of or under the supervision of your parent or legal guardian.  If we learn that we have received any information directly from a minor under the age of thirteen without first receiving his or her parent’s or legal guardian’s verified consent, we will use that information only to respond directly to that minor (or his or her parent or legal guardian) to inform the minor that he or she cannot use the Services and subsequently we will delete that information.

CHANGES TO OUR PRIVACY POLICY

PostBidShip may modify this Privacy Policy at any time and post such modifications here on this web page.  Your continued access and use of the Services following the posting of any revised Privacy Policy will be deemed acceptance of the revised policy.  You should therefore periodically check our Privacy Policy for updates.

LOCATION OF OUR SERVERS

If you are visiting our Services from outside the United States, please be aware that our Services and the servers that host it are located in the United States and any information or data you provide, including personally identifiable information, will be transmitted to the United States and subject to access requests by U.S. authorities.

GENERAL

This Privacy Policy is a part of our Terms and Conditions. The terms set forth in our Terms and Conditions, including your agreement with respect to the governing law and venue in the event of a dispute, apply to this Privacy Policy.  The policies indicated in our Privacy Policy will remain effective, even if the Terms and the other agreements between us are terminated and you are no longer using our Services.
